One of the biggest factors in any personal injury lawsuit is when the injured party has to fulfill the burden of proof. The burden of proof is really just the responsibility of the injured party proving that the property owner was negligence and caused them to become injured. This may seem daunting to many injured parties, especially if they feel as though this is an impossible task.
Arguably the best way for an individual to fulfill the burden of proof in New Jersey is for the injured party to take photos or videos of the conditions that caused the accident. It is always best for these pictures to be taken before leaving the scene of the accident so the conditions are just as they were when the accident took place. If not, the property owner may have resolved the conditions before the injured party is able to return and take pictures for evidence. In some cases, there may be surveillance footage available of the accident. The injured party may also want to determine whether there were any witnesses to the accident and obtain their contact information.
