How Do I Prove My Injuries?

As part of your lawsuit, you may be asked to see a doctor on behalf of the insurance company for the party that we are suing. They call these independent medical examinations, but they’re truly known as defense medical examinations. What that means is this is a doctor hired by the other side to examine you and do his or her best to write a report that will exclude or minimize your injuries or damages. They want to make sure that their client only has to pay you as little as possible for the damages that they were responsible for in your accident. You have to remember that these doctors are working for the other side.
As part of my representation of you, I will prepare you for these examinations. When you see these doctors you will truthfully tell them all of your complaints, your medical history, and any other relevant information so that they will have the hardest possible time minimizing your claim. It is important that you are as truthful as possible with the doctor because they will know when any injuries occurred, so if you claim a certain pain only occurred after the accident but it was from a previous unrelated injury, this will work against you in your case. Providing the absolute truth about your injuries is of the utmost importance throughout these independent medical exams if you want the best results for the outcome of your case.
